Georgia, Supreme Court, Atlanta : Sullivan, administrator v Hugly et al, by next friend, Collier, March 1861

Summary: The bill was brought against Sullivan as administrator of Franklin Hugly, deceased, by Collier as next friend of ten minors who alleged that they were the next of kin and heirs-at-law of Franklin Hugly on the paternal side and who as such claimed ten fourteenths of his estate. Sullivan stated in his answer that the plaintiffs were not the heirs of Hugly as they claimed to be; that the portion of the estate claimed by them had been legitimately distributed by him among the brothers and sisters of Hugly's mother, who were his own children; and that Franklin Hugly had been illegitimate and of mixed race, rendering him legally incapable of taking by will and voiding the bequest made to him by Amos Hugly, his mother's husband, who was the source of the property in dispute in this case. The slaves held by the estate were estimated to be worth [dollars] 15,000. The jury found a verdict for the plaintiffs for [dollars] 10,710 and Sullivan moved for a new trial; this being refused, he appealed. The Supreme Court affirmed the verdict, ruling that there were insufficient grounds to rebut the legal assumption that Franklin Hugly had been legitimate.
